1. Scope
These Terms of Use govern access to and use of the TreffPunkts platform. The platform enables users to discover, create and manage activities, register for them and communicate with other users.
2. Role of the platform
TreffPunkts provides technical communication and organization infrastructure. TreffPunkts is generally not the organizer of user-created activities, is not a contractual party between participating users and does not guarantee that listed events will take place, be safe or meet expectations.
3. Registration and account responsibility
- Users must provide truthful and up-to-date information when registering.
- Login credentials must be kept confidential and protected against unauthorized access.
- Each user is responsible for all activity carried out through their account.
4. User content and activities
- Users are responsible for their profiles, messages, reviews, images, event descriptions and other content.
- Users may only upload or publish content for which they hold the necessary rights.
- Organizers or activity creators are responsible for the conduct, safety, accuracy and communication relating to their activities.
5. Visibility and contact between users
Depending on the feature used, profile data, event data, participation information, reviews or communications may be visible in whole or in part to other users. By posting content or participating in activities, users acknowledge this function-related visibility.
6. Real-world meetings and personal responsibility
- TreffPunkts is not liable for the conduct of users during offline meetings or other real-world interactions.
- Users decide at their own risk whether, when and with whom they communicate, attend activities or arrange meetings.
- Users are responsible for taking appropriate precautions and for complying with applicable laws, venue rules and safety requirements.
7. Prohibited use
In particular, the following are prohibited:
- illegal, abusive, discriminatory, harassing or dangerous conduct or content,
- impersonation or false statements about identity, qualifications or events,
- spam, abusive contact or fraudulent use of the platform,
- publishing content that infringes third-party rights.
8. Moderation and enforcement
TreffPunkts may review, restrict, suspend or remove content, events or accounts where there are indications of violations of these terms, legal obligations or safety interests.
9. Communications and reporting
If chat, contact or notification functions are provided, they may only be used lawfully and for platform-related purposes. Users should promptly report problematic content, abuse or safety concerns.
10. Fees and external arrangements
To the extent the platform currently does not charge its own fees, this may change in the future. Arrangements between users, especially regarding payments, participation conditions or cancellations of activities, are generally made directly between the involved users.
11. Availability
TreffPunkts aims to keep the platform available, but does not guarantee uninterrupted or error-free operation. Maintenance, technical issues, security measures and changes to features remain reserved.
12. Liability
TreffPunkts has unlimited liability in cases of intent, gross negligence and for injury to life, body or health. In the event of a slightly negligent breach of essential contractual duties, liability is limited to the foreseeable damage typical for the contract. Otherwise, liability is excluded to the extent permitted by law.
The above limitations apply in particular to user conduct, real-world meetings, user-organized activities, user-generated content and external third-party links or services.
13. Indemnification
Users shall indemnify TreffPunkts against third-party claims arising from content, activities, infringements or other violations for which the user is responsible.
14. Privacy
Information on the processing of personal data can be found in the Privacy Policy.
15. Governing law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods, unless mandatory consumer protection law provides otherwise.
